Ohio Rules of Professional Conduct 1.4(c) Required Notice

Launch Law is a platform created by Eques, Inc., an Ohio S-Corp and law firm. As such it is necessary to notice you that Launch Law is only providing a platform for completion of legal forms and not extending you any traditional legal service. And, pursuant to the Ohio Rules of Professional Conduct (1.4(c)) you are hereby notified that Eques, Inc.’s professional liability (malpractice) insurance does not cover the Launch Law platform, and any use by you thereof, of at least $100,000 per occurrence and $300,000 in the aggregate. This notice is electronically created and signed by our Managing Partner, Christopher M. White, Esq.. You will be required to acknowledge this notice and the following terms and conditions before completing any form(s) on the Launch Law platform.

Welcome to Launch Law, a platform powered by Eques, Inc. 

If you are looking for a Do-It-Yourself (“DIY”) platform where you select what template you want to build and you provide the information for your personal use in the great State of Ohio, you’ve come to the right place! For anything else, we are sorry but Launch Law is not yet ready for you – but Eques, Inc. may still be able to help. These Launch Law Releases, along with the associated DIY Purchase Acknowledgment and Launch Law Content Policy (collectively, “Terms”), cover your use and access to the software, products, forms, platform, and website (collectively “Product”) you are currently on, provided by Eques, Inc. and their affiliates, heirs, agents, representatives, executors, and assignees (collectively, “Launch Law”). 

By continuing to use the Product platform of Launch Law, or by using Launch Law on behalf of any person or entity, you are agreeing to these Terms on your behalf, or on behalf of that person or entity. 

You agree that you are of age to enter into a binding contract with Launch Law, and that you have the authority to do so for either yourself, or the person or entity you are representing. 

If you do not agree to any of the Terms, or are unable to enter into a contract with Launch Law, please leave Launch Law’s platform immediately.

Launch Law is Not the Same as Seeing an Attorney

Launch Law is a DIY form creation platform, powered by Eques, Inc., and it does not provide legal advice of any kind. No attorney has provided specific, directed, legal counsel in the drafting of your form, in the selection of your form, or in any other way as it relates to you specifically. Launch Law is not a substitute for legal advice.

If you have any questions or concerns about whether a form is right for your situation, or how the form may affect your legal rights, you can and should contact an attorney in order to obtain legal advice.  Launch Law does not provide legal advice.

Launch Law User Acknowledgements

As a user of the Launch Law platform, you acknowledge and accept the following:

You have not received any legal advice from Launch Law or Eques, Inc. in choosing or completing the Products;

You understand and acknowledge that Launch Law is a Do-It-Yourself (“DIY”) legal document platform and is not the same as hiring an attorney;

You understand that the Products are not selected or tailored for me;

You understand that if you have any questions, you can and should seek qualified legal advice from an attorney licensed to practice law in the State of Ohio;

You understand that you are only purchasing the Product provided by the Launch Law platform and not any advice or guidance on the usage of that form;

You understand that you are entering into a business transaction with Launch Law to buy a Product which you have selected for your own use;

You understand that upon purchase and electronic delivery of the Product the scope of the solutions offered by the Launch Law platform has been completed and is satisfied (no further services are contemplated by you or Launch Law);

You understand and acknowledge that the Products you purchase from Launch Law are form templates that you have chosen and designed entirely through your own input and decision making;

You understand and acknowledge that you, and you alone, are solely responsible for the creation, editing, and use of any Product you purchase from Launch Law;

You understand and acknowledge that you, and you alone, are solely responsible for any mistakes on any Product you purchase from Launch Law, and that you, and you alone, are solely responsible for the use of any Product you purchase on Launch Law;

You understand and acknowledge that you are responsible for all content submitted to Launch Law, that you will not use Launch Law for any content that violates the Launch Law Terms & Conditions, and that you will not provide any content to Launch Law that you do not have a legal right to provide; and

You understand and acknowledge that if you do not understand how to use any Product that you purchase on Launch Law, or if you have any questions regarding how the use of any such Product might affect your legal rights, then you can and should contact an attorney licensed to practice law in the State of Ohio to give me advice.

Using A Launch Law Product

You understand that all Launch Law Products are for use only in the State of Ohio.  Launch Law Products are not intended for use outside of the State of Ohio.  You understand that if you want to use any Product that you create using Launch Law anywhere outside of the State of Ohio that you should consult with an attorney licensed to practice in that jurisdiction in order to understand whether the document can be used in that jurisdiction.

You understand and acknowledge that you decided what document to create using Launch Law.  You will use that document as you think best. You understand and acknowledge that any materials, guides, FAQs, or similar information provided by Launch Law are for your personal informative purposes only.  You received no specific, directed legal advice on how to complete, or use, any document.  You understand that if you have any questions about your legal rights, or if you need any assistance in selecting the right documents, you can and should contact an attorney licensed to practice law in the State of Ohio to give you advice. The team at Eques, Inc. is ready to help should you need any.

You understand and acknowledge that you are solely responsible for any use of a Product for any purpose. 

Refunds of a Launch Law Product

We want you to be 100% satisfied with your product from Launch Law. If you are less than satisfied, or believe there has been an error in billing, please contact us via email at support@launchlawinc.com or by phone at (330)-439-5925, so we can help you resolve the issue. Launch Law will have the sole power to determine the appropriate remedy for any concern, and if it is decided that a refund is necessary, we will refund the full amount to the account you provided at checkout.

Launch Law Communications

You understand and acknowledge that you may receive electronic communications from Launch Law regarding its products and platform. 

You understand and acknowledge that Launch Law has a right to send these electronic communications to you, and you consent to their receipt.  

Understanding The Launch Law Terms & Conditions

You understand and acknowledge that by any use of the Launch Law Website, and/or by the use of any Launch Law Product,  you have read these Launch Law Terms & Conditions, understood these Terms & Conditions, and will abide by these Terms & Conditions. By proceeding to purchase a Launch Law Product, you understand and acknowledge that you accept all these Terms and Conditions.

YOU UNDERSTAND AND ACKNOWLEDGE THAT IF I DO NOT WANT TO BE BOUND BY ALL THESE TERMS AND CONDITIONS, YOU WILL IMMEDIATELY STOP USING THE LAUNCH LAW WEBSITE, AND You  WILL NOT USE ANY LAUNCH LAW PRODUCTS. 

You understand and acknowledge that this purchase from Launch Law is a one-time purchase of a Product that you created.  You understand and acknowledge that Launch Law is not obligated to sell me any additional Products or related or unrelated legal service. 

You understand and acknowledge that Launch Law, for any legal reason, reserves the right to terminate all future agreements with you. 

Launch Law Privacy Policy

Neither Launch Law nor any of its partners are holding themselves out to any consumer in Europe, or who has an EU Member State Citizenship, for any reason what-so-ever. If you are not a citizen of the United States, and the United States alone, and/or are not using the Launch Law platform within the United States, and/or intend to use the Launch Law platform or Products for any use outside of the State of Ohio, including with a citizen of another state or country in any way, you must cease using Launch Law immediately. 

If an electronic signature has been provided to Launch Law for the purpose of affixing said signature to any Product, you consent to the affixing of that signature in order to allow for forms to be filed or otherwise created. You have a right to withdraw this consent up to the point of the filing or creation, when it no longer would be possible to withdraw; please contact Customer Service by email at support@launchlawinc.com or by phone at (330)-439-5925 to find out more. 

Depending on the nature of the Product you purchased from Launch Law, there may be state or federal Identification requirements, including, but not limited to: your name, social security number, phone number, address, spouse’s information, children’s information. Should Launch Law be required to file with any state or federal agency on your behalf, you give permission to Launch Law to use any identifying information you have provided as Launch Law finds to be necessary. You further grant to Launch Law any rights or powers necessary to submit any documetns, forms, answers, or any other filing on your behalf, as part of your Product purchase from Launch Law.

Launch Law is offering you a Product platform in the form of DIY form templates. This Product platform is not an adequate substitute for legal services rendered by an attorney that knows your situation and can tailor a solution to fit you needs. Launch Law makes no assertion that any Product will fully fit and completely meet your unique situation. The above privacy policy is the extent of your legal protections. By continuing to use the Launch Law platform, you agree to this, completely understand this risk, and fully understand your responsibilities. 

Launch Law Content Policy

Launch Law takes no responsibility and assumes no liability for any content posted by you nor any third party.

In your use of Launch Law, you shall follow all legal, ethical, or otherwise obligatory rules, laws, and regulations on any content you upload, design, create, publish, or otherwise modify using the Launch Law Platform.

You shall not upload, design, create, publish, or otherwise modify any document with content which:

Is known by you to be false, inaccurate, misleading, and/or fraudulent;

Is designed to harasses, abuse, or otherwise illegally harm a third-party;

Is pornographic;

Contains a trade secret or any other proprietary right, without consent of all owners;

Infringes on any copyright, patent, trademark, or other intellectual property concern;

Infringes on a third-party’s rights to privacy or publicity;

Is defamatory, libelous, hateful, racially offensive, religiously offensive, unlawful, or threatening

That contains any computer virus, worms, feedback loop, or any other damaging computer program, file, or image map; or

Any materials which it would be illegal for you to provide.

Launch Law Release of Representations and Liabilities

Any and all forms, templates, products, information, search query, creations, drafts, or other Products provided by Launch Law may include inaccuracies, clerical errors, typographical errors, or other similar concerns. You are aware of this, and you are aware that it is your obligation to correct any such errors.

Any and all forms, templates, products, information, search query, creations, drafts, or other Products provided by Launch Law are created at your discretion alone, and are not the product of any intentional choice by Launch Law, Eques, Inc., or any attorney so person so affiliated. Because these Products are provided as modified by you for your own personal reasons, there can be no joint claim of injury, or any other reason to join or consolidate classes together.

Any and all forms, templates, products, information, search query, creations, drafts, or other Products provided by Launch Law should not be relied upon for personal, legal, financial, or medical decisions. CONSULT AN EXPERT.  If you have questions regarding the use of any form, or how those forms affect your legal rights, you can and should contact an attorney of your choice to obtain legal advice.

To the complete, greatest, and fullest extent as permitted by law, Launch Law, makes no warranty, either express or implied, about the Products of Launch Law. All such Products of Launch Law are provided “As Is”, with no warranty, express or implied, relating to merchantability, fitness for any specific purpose, non-infringement, or any other reason besides personal, private use.

The license granted by these Terms is a limited, non-exclusive, non-transferable, revocable, license for the duration of these Terms. 

You are permitted to:

Download, view, copy, and print the form you have purchased for your personal use;

Download, view, copy, and print the form you have purchased for a business-related purpose you have selected, without any input from Launch Law, assuming all risks and responsibilities upon yourself.

You are not permitted to:

License, sublicense, sell, resell, assign, distribute, or in any other way transfer or make available to any person besides yourself, or the entity you represent, the Products provided by Launch Law;

Modify, reverse engineer, reproduce, or in any other way create a derivative work based upon, referring to, or exploiting, the Products or platform provided by Launch Law;

Use Launch Law or any Products to violate any law.

If any right is not expressly granted to you, it is completely preserved, reserved, maintained, and held by Launch Law. 

To the complete, greatest, and fullest extent as permitted by law, Launch Law shall not, in any event, be liable for any direct, indirect, special, incidental, exemplary, consequential, punitive, or any other form of damages caused by the use of any Products provided by Launch Law.  

More specifically, but not limited to, by using the Products of Launch Law, you agree that, on behalf of yourself, your heirs, agents, representatives, executors, and assignees, you:

Fully release, discharging forever, Launch Law from any and all losses, damages, expenses, claims, or other actions arising out of your use of the Products;

Hold Launch Law harmless from and all losses, damages, expenses, claims, or other actions arising out of your use of the Products;

Should any action arise against Launch Law as a result of your use of the Products, shall act to interplead on behalf of Launch Law against the third-party, in order to fully release, discharge forever, and hold harmless Launch Law from any third-party;

Should Launch Law incur any cost, from any source for any reason, as it relates to your use of the Products, you shall pay either to, or on behalf of, Launch Law that cost in order to make Launch Law whole.

Launch Law reserves the right to remove or delete any material from its servers for any reason, and reserves the right to interpret the Terms as Launch Law sees fit.

Launch Law will cooperate fully with any law enforcement officials or agencies in the investigation of any violation of these Terms, or for any other lawful investigation.

Launch Law Legalese

These Terms constitute a full and final understanding between you and Launch Law, superseding all previous contracts of this nature between you and Launch Law, and shall be binding on and inure to the benefit yourself, your heirs, agents, representatives, executors, and assignees, as well as Launch Law. No previous nor future contract, nor discussion, will be considered to have been part of these Terms. These Terms shall be governed, construed, and interpreted by the laws of the state of Ohio; more specifically any governance, construction, or interpretation shall only be properly initiated in the Holmes County, Ohio, Common Pleas Court, as a bench trial, with no jury trial allowed. If any provision of these Terms, or the application thereof, shall, for any reason, be invalid or unenforceable, neither the remainder of these Terms, nor the application of the provision to other circumstances, shall be affected, but shall instead be enforced to the maximum extent possible by law. If, at any point, any given party chooses to not exercise a right or allowance granted under these Terms, or under State Law, it shall not be construed as a waiver or limitation for any future enforcement of any right or allowance.

The Terms that are currently active (as indicated by “last modified” date under the title) at the time of any given sale will be the Terms that govern that sale. Launch Law reserves the right to modify these Terms at any given point, which will apply to any sale going forward. 

All descriptive headings used in these Terms are for convenience of reference only, they are not intended to have any effect whatsoever in determining rights or obligations of you or Launch Law.
